FAQ

Questions people ask

Do we need to live separately for a year first?+

Under Section 13B of the Hindu Marriage Act, spouses must have lived separately for at least one year before filing.

Can a working wife claim maintenance?+

Possibly, if her income isn't enough to maintain the standard of living she had. The court compares both incomes.

Can I stay in the marital home?+

Yes. The DV Act protects your right to reside in the shared household, and the court can pass a residence order.

How long does a court marriage take?+

At least 30 days from the notice under the Special Marriage Act, plus appointment time.

Is a handwritten will valid?+

Yes, if it's signed by you and attested by two witnesses. A properly drafted and registered will is still better for avoiding disputes.
